It is well for a man if he is able conscientiously to feel that his views on the great questions of the day, on such questions as the tariff, finance, immigration, the regulation of the liquor traffic, and others like them, are such as to put him in accord with the bulk of those of his fellow citizens who compose one of the greatest parties: but it is perfectly supposable that he may feel so strongly for or against certain principles held by one party, or certain principles held by the other, that he is unable to give his full adherence to either. In such a case I feel that he has no right to plead this lack of agreement with either party as an excuse for refraining from active political work prior to election. It will, of course, bar him from the primaries of the two leading parties, and preclude him from doing his share in organizing their management; but, unless he is very unfortunate, he can surely find a number of men who are in the same position as himself and who agree with him on some specific piece of political work, and they can turn in practically and effectively long before election to try to do this new piece of work in a practical manner.

(1) This case involves civil, criminal, and administrative law. Why is the action set in the civil system? How would the other legal systems (i.e., the criminal system, contract law, etc.) have addressed the issues in the case?
(2) There are significant pretrial matters outlined in the book. With a lawsuit this large and complex, how could/did the lawsuit proceed in a fairer and/or efficient manner?
(3) This case ultimately boils down to a negligence cause of action. Address how each element of negligence was presented in this lawsuit.
(4) Did the judge maintain flexibility and stability throughout the case? Why and/or why not?
(5) There are significant ethical issues for all parties and witnesses in this case. Who acted ethically and who failed to do so in this case?
(6) Discuss the events in the case that could have ended the action. Given the time and expense, should the lawsuit have resolved short of trial?
(7) Key witnesses in this trial lied and/or were misleading in their testimony. How can/should non-truthful statements be handled in a court of law.
Your essay should be no less than 1000 words and no more than 1200 words. Direct quotations and paraphrases should be correctly cited from the book. The essay should follow a standard introduction, body, and conclusion format.
Remember, I want your REFLECTION on the book, not a summary of the book. Apply what you have learned in class to the material the author presents in the book.
The organization of the paper will follow a consistent pattern of identifying the legal issue or rule, analyzing the issue to the facts of the case in the book, and a conclusion consistent with the thesis of your paper.

You are a nurse in the emergency department at the local hospital. One of your patients today is a 17 year old female named Ali who came in with a forehead laceration. The laceration occurred when the patient hit her head on the steering wheel as her car rear-ended the vehicle in front of her. The patient states “I was texting my friend that I was running late. When I looked up, the vehicle in front of me had stopped and I barely had time to hit the brakes on my car.”
The driver from the vehicle Ali hit is also in the emergency department due to neck and back pain following being rear-ended. You are concerned about Ali’s safety and the safety of other drivers in regard to her texting while driving. When you ask Ali about how she feels about texting and driving after the accident, she states, “I didn’t ever think something like this would happen to me. I wonder if the other driver is alright. Last I saw, he was being taken somewhere in the ambulance.”
