Turnitin®
Turnitin® enabledThis assignment will be submitted to Turnitin®.
Instructions
Purpose: This assignment will enable you to discover a short story’s use of elements such as theme, characterization, irony, metaphor, and symbolism. You will conduct a close reading of a short story and discuss the author’s use of these devices in his or her structuring and composition of the content. Applying a close reading and composing a literary analysis will prepare you for the many texts that you will read, summarize, and discuss in your future studies and even the workplace.

Task:

Write an essay analyzing one of our stories from this Unit (by Ron Rash, Ken Liu, or Rebecca Roanhorse) that discusses why and how specific symbols, metaphors, uses of irony, or characters are used to depict one of the themes from Unit 1 (Love, Alienation/Otherness, the American Dream/Nightmare, Quest for Identity/Coming of Age, or Conformity/Rebellion) in a particular way. Your essay should incorporate details and quotes from the story, and you should use your own words to elaborate on the meanings of the details and quotes you use as evidence. Follow these steps:

Choose one of the Short Story Selections from this Unit – you can certainly choose a story you focused on in one of the discussion forums, but you don’t have to.
You will closely read (and reread) your chosen story, considering its themes, characters, organization, dialogue, setting, symbols, metaphors, irony, allusions, and other literary elements. Take notes!
To start to compose your working thesis, consider which theme you find most applicable to the story and what elements contribute the most to that theme. How do these elements contribute to the theme? Why did the author choose to use them this way?
Compose your outline. Use the MEAL Plan outline to guide the structure of your paper.
As you flesh out your outline with evidence and original analysis to form it into a complete essay, be specific in your use of details and use well-chosen quotes to support your thesis. Integrate quoted material logically and grammatically, and use parenthetical documentation with the author’s surname. Avoid plot summary.
Be sure to maintain an appropriate academic tone (no slang, second-person [“you,” “we”], contractions, etc.)
Please refer to the Purdue Online Writing Lab for MLA formatting and style guide.
Leave time to submit your draft to Free Tutoring for review. Your tutor can help with thesis and content development, organization, grammar, and mechanics. Utilize this free service to write the best draft possible on this major assignment. Don’t forget that you can submit your draft to Free Tutoring multiple times during the revision process.
Submit your final paper in the Unit 3 Essay: Short Story Analysis dropbox. Remember, your instructor will be able to see your Turnitin results – both your similarity percentage and any phrases or language that appear elsewhere, either online or in Turnitin’s database of prior student work, so ensure that your work is scrupulous in its citations and adheres to the standards of academic honesty.
When writing your essay, the goal is to demonstrate what spin the story has on a particular theme. Be specific about the ways the theme is used and how the story’s use of symbols develops a deeper meaning to the theme. Provide details, including cited direct quotes from the story, but don’t forget that you must integrate the quotes grammatically and logically and comment on the quotes you use to explain why they are significant.

File submissions: Please submit your file as a DOC.X or PDF file.

Criteria on Which You Will be Graded:

The specificity and development of your thesis
Your supporting claims, logic, and organization
The quality of your writing, to include paragraph development and organization: topic sentences, conclusions, transitions, etc. See Starting Your Short Story Analysis Essay.
Your engagement with the text (how you explain your examples, your choice of supporting quotations)
Format: You are required to use current MLA style for all writing assignments. Proper MLA citation and a correctly formatted Works Cited page (12-point font, Times New Roman, double spacing, Last name and page number on each page, etc.). Please refer to the Purdue Online Writing Lab for MLA formatting and style guide. See this sample ENGL 1102 essay.
Academic Honesty (NO secondary sources are needed or encouraged; however, if any external sources are used, they MUST be appropriately cited using MLA 8th edition format). As always, plagiarism is not tolerated. Please ask if you have questions about citation or academic honesty.

AND ANALYTICAL ESSAY ON THE 1967 WAR (ARAB-ISRAELÍ CONFLICT) AND ITS IMPACT ON THE “NATIONAL” LEVEL AND THE REGIONAL LEVEL essay help online free: essay help online free

Hello. You have to do a UK POLITICAL CRITICAL AND ANALYTICAL ESSAY. Read carefully the instructions, I will know if you don’t. Follow every step when planning and writing the essay. The question you have to address is: THE 1967 WAR IS REGARDED AS A PIVOTAL EVENT IN THE COURSE OF THE ARAB-ISRAELÍ CONFLICT. WHAT IMPACT DID IT HAVE ON BOTH THE “NATIONAL” LEVEL AND THE REGIONAL LEVEL.

Now, I’m going to explain how I want you to do the essay.

1- ORGANISATION: You have to clearly define and directly address this question and topic. The introduction must present a clear statement of the issues to be covered. The essay must have a clear structure or organization in which a) the main points are developed logically, and b) the relevance of the material to the theme or argument is clear. Besides, the conclusion must draw together the main points addressed and discussed in the introduction. It must be clear what the essay intends to do and the points it tries to defend. You must give a clear answer to the title question; WHAT IMPACT DID THE 1967 WAR HAVE ON BOTH THE “NATIONAL” LEVEL AND THE REGIONAL LEVEL? IT IS VERY IMPORTANT THAT each section of the essay must have a clear role in establishing your conclusion. DON’T JUMP BETWEEN TOPICS WITHOUT A CLEAR RATIONALE. Argue in a direct way, informed by background reading. You are encouraged throughout the essay, to rely on your argumentations, to use maps, tables, diagrams, and quotations (you can find some in the readings) , properly referenced. I can upload some of the ones you can use, but you can obviously use others you consider useful.

2-INDEPENDENCE: You have to point out an interesting flaw in an argument, or an interesting implication of a view; take an idea from one author and apply it to another; draw an interesting connection; explain a difficult point in an especially clear or helpful way; unpack an overlooked detail and show its importance and have a focus that isn’t simply drawn from the lecture content.

3- REFERENCING: You have to reference in a very accurate way, using the APA style. Besides when you reference in the text, put also the exact page where you found or rely on that information.

Be critical, analytical, follow the scholarship, independence and organisation guidelines, IT IS VERY IMPORTANT. For answering the political question YOU MUST use the compulsory readings which are: Milton-Edwards, B. (2009) The Israeli-Palestinian Conflict: A People’s War (Oxon/New York: Routledge), chapter 6 AND Milton-Edwards, B. (2009) The Israeli-Palestinian Conflict: A People’s War (Oxon/New York: Routledge), chapter 6. Then you have to read the other 7 readings I have uploaded. In total, you will have to use at least 9 readings. Besides, you have to use other readings you found accurate BUT AT LEAST YOU HAVE TO USE 9 READINGS OF THE ONES I UPLOADED.
PD: On the “Six Days, Fifty Years: The June 1967 War and its Aftermath” you don’t have to use all the chapters if you don’t consider to. Just select those or the chapter you consider can help you for your argumentation.

THINGS YOU MUST AVOID IN THE ESSAY: Defending a conclusion in ways that draw a bit too closely on what was said in the lecture notes. Showing grasp of only a rather limited amount of reading. Having a limited authorial voice of your own: just presenting a list of arguments/positions.

If you have any kind of doubt or questions, please ask me.

Evidence based Responds college essay help

Discussion 1

I have experienced patient involvement in treatment and healthcare decisions for a patient with diabetes who wanted more information on patient education and self-management. Still, there is a challenge to prioritize patients’ preferences and professional when patients lack information and knowledge.  The diabetic patient wished to be involved in shared decision-making. Preferences are one of the considerations in shared decision-making, including treatment and management decisions. Trust in physicians and nurses likely influenced the patient’s willingness to participate in shared decision-making.

Evaluating what influences patient preferences for participating in healthcare decisions is helpful to promote informed decision-making as there would be a focus on facilitating shared decision-making. Meeting patients’ needs and evaluating their preferences should be a top priority, and promoting patient engagement makes it easier to determine patient preferences. In decision-making, it is necessary to consider the benefits and risks of decisions and patient preferences to inform patient decisions and involvement (Friedrichs et al., 2016). Patient preferences are increasingly prominent in shared decision-making about care and treatments, and getting informed is necessary to reduce knowledge deficit and make decisions based on the best evidence.

Even if patients engage in active decision-making, using the best evidence to support clinical decisions is necessary. Thus, in the case of the diabetic patient, it was necessary to respect the patient’s autonomy preferences while exercising professional judgment. Patient preferences can influence treatment choice, and in patient-centered care, there is a focus on supporting patients and families to make informed decisions (Lindsay et al., 2020). Patient-centered communication, patient education, and empowerment facilitate shared decision-making. Hence, patients and families make informed health care decisions, and patient-centeredness is essential for promoting high-quality health care.

The Ottawa Hospital Research Institute inventory of decision aids is one tool that facilitates clarifying patient choices and using the best evidence to support decisions. Personalizing patient decisions and enabling patient involvement is one of the benefits when using the decision aid. Diabetes is one of the specific conditions in the decision aid, and the type of decision aid is treatment, and the target audience is adults with diabetes type 2 (Ottawa Hospital Research Institute). Patient decision aids present individualized information and interventions tailored to the patients’ needs.

Respond to my questions in paragraph form in the assignment labeled #4 Hughes.
Please note that you may find the essay a bit difficult to follow, since it is an academic essay
slated for publication in The Langston Hughes Review, as opposed to lecture notes. Read also
my Notes on Coloring the Character, which further explains and breaks down the ideas in the
longer article. I present the article to you because it contains most of my thinking about this
challenging and deeply rewarding poem, and it also introduces you to the world of reading
academic criticism, which is a skill in and of itself. If you find some passages incomprehensible,
you can ask me questions or just move along. One important aspect of Hughes’ achievement
in this poem is his inquiry into the nature of reading and writing, and since that is precisely what
we are doing in this course, it seems a fitting choice to really focus hard on. Refer to the three documents that I’ve given you.

One of the techniques used in Lean Methodology is Rapid Cycle Tests of Change. The idea is that if college application essay help

One of the techniques used in Lean Methodology is Rapid Cycle Tests of Change. The idea is that if you have an idea for improvement but are not sure if it will work, try it! Try it on one patient, one day, one time. That information can be used to find flaws or improvements in your idea. It saves time and money by limiting the implementation and education costs until you are relatively sure it can be implemented and will save time and/or money. The linked article below describes the FOCUS-PDCA process and how to use it.

By testing changes this way, you:

Minimize risks and expenditures of time and money
Make changes in a way that is less disruptive to clients and staff
Reduce resistance to change by starting on a small scale
Learn from the ideas that work, as well as from those that do not
Thus, by starting with small changes to test ideas quickly and easily, and using simple measurements to monitor the effect of changes over time, rapid-cycle testing can lead to larger improvements through successive quick cycles of change.

After reading the articles below, think about a Rapid Cycle Test of Change you could implement to try out a new idea, either in your home, work or school studies. Describe what you would do, then try it, and let us know the results!

Science of Improvement: Testing Changes (http://www.ihi.org/resources/Pages/HowtoImprove/ScienceofImprovementTestingChanges.aspx)

Post: Copy the statement above to start your post. It can make it easier to answer the question fully. Length should be 1-2 paragraphs. Write enough to make your point. This will be worth 5 points. Your post should be completed by Wednesday or Thursday of the week due.

Problem 6- Planning essay help online: essay help online

1.Cost reimbursable contract calculation.

A contract calls for a total payment of $800,000 with a guarantee. Essentially the contractor is guaranteed to make at least $200,000 above his costs. If the contractor can demonstrate his costs exceed $600,000, the project will pay the difference, with a $50,000 ceiling on the overage. The contractor demonstrates he spent $623,000. How much (gross) must the project remit to the contractor?

Another option for the same contract has the contractor guaranteed to be paid his costs plus 20%, for costs that exceed $600,000. With the same initial assumption—guarantee of $800,000 gross payment (no requirement to itemize costs), but if the contractor can show that costs exceed $600,000, the project will pay $800,000 plus the costs that exceed $600,000, plus 20% of those excess costs, with a ceiling of $900,000 gross. The contractor demonstrates he spent $623,000. How much (gross) must the project remit to the contractor?

Under option 1.b, at what dollar amount of total costs would the contractor be assuming all of the excess costs beyond that point?

In which option did the project assume more of the risk of a cost overrun? Explain.

At this point in the course, you should have read a few articles related to your literature review topic. You should be taking notes on the articles you read and be critically examining the empirical essay help

You should be taking notes on the articles you read and be critically examining the empirical evidence. Here I’d like you to develop one possible argument that you could make in your literature review.
One possible argument is that a gap exists in the literature. If you use this argument specify precisely where this gap might exist (e.g., please no vague assertions here). For example, if your topic was interventions for generalized anxiety disorder perhaps one gap is in research examining mindfulness techniques.
Another argument might be that there is a controversy. If you use this argument specify exactly what the controversy is (again veer away from vague answers). For example, there may be a controversy around the idea that stereotype threat is caused by increased anxiety.
Finally, you might have a state of the art (or state of the state) argument. Be clear what is new. Here, you might argue that psychedelic  drugs present a new and exciting approach to treating PTSD.
Please upload a clear and specific discussion of an argument for your paper here.

Advertising or Free Speech? The Case of Nike and Human Rights
This week’s discussion is about Corporate Social Responsibility (CSR), focusing on the brief case study about Nike (p.101 in the textbook).
Nike pioneered offshore manufacturing by hiring third-party contractors in developing nations to work in its company-owned plants. Among other workers, the contractors hired minors at low pay in” sweatshops.” When the news became public in 1996, Nike faced negative public opinion, and then it established a Corporate Responsibility and Sustainability Committee to ensure that labor practices were ethical across its supply chain.
After that, Nike was sued for allegedly knowingly making false and misleading statements in denying its direct participation in the abusive labor conditions abroad in manufacturing its products. The case was dismissed for procedural issues by the U.S. Supreme Court. Thereafter, Nike has worked on building its CSR profile through relief efforts and advocating fair wages and employment practices in its outsourced operations.
Thinking about Nike’s corporate practices, if you were to start a company that outsourced labor in order to reduce manufacturing costs, what decisions would you make to combine commercial objectives with social goals to improve the impact of corporate social responsibility efforts? How might the two conflict?
Embed course material concepts, principles, and theories, which require supporting citations along with two scholarly peer-reviewed references supporting your answer. Keep in mind that these scholarly references can be found in the Saudi Digital Library by conducting an advanced search specific to scholarly references.

Write a 750–1000-word essay about your understanding of the concepts from the textbook, through the lens of the media links you watched and in context of your life (You’re your conventional wisdom/common sense and try to become a social analyst by shifting your paradigm). Tell the readers what you watched, listened to, and read and how these impacted your understanding of the “taken for granted world.” Write how these links helped you understand chapters concepts and in what ways. It is especially interesting if you can tell us about the preconceived notions you had about some topics and how the information in the media helped change, reinforce, and/or modify that conventional wisdom. This process may be challenging at first, but I promise, it will get easier with each board. These are not summaries of what you READ and WATCHED. They are learning documents showing what you learned, how you are making connections (micro/macro) and how you are developing your sociological imagination and/or your sociological perspective. There are integration requirements for each essay.

Integration Requirement 1: FOUR concepts from each chapter in the relative module.
Integration means you needs to spread terms throughout the essay – do not bunch them all up in one paragraph. Highlight ONLY the first important time you reference a textbook word, concept, date, or person to help me assess your ability to integrate the new terminology. Do not highlight a whole sentence or paragraph, just the term. Use a different color for EACH CHAPTER and provide a KEY to help me grade.
Integration Requirement 2: THREE Media links from that module.
Use a signal phrase to introduce the media links when you use them the first time. You will use the same color for all the media (as if they are their own chapter).
Integration Requirement 3: TWO Insights derived from your life.
This is where and how you use your sociological imagination, showing the micro macro connections your coursework is revealing. Bold/Italics these tidbits. Consider your life thus far and how the textbook concepts and the media links can shed light on or lift the veil from aspects of your life. In other words, write about your developing sociological perspective and show us how you are developing your sociological imagination.
Example: “As I learned about Marx’s concept of the false consciousness, I was struck by the way I’ve noticed this happening at work. For instance, my colleagues and I are the proletariat, and we are often in competition with each other and do not look at our bosses for an understanding of why we cannot get a raise. This especially occurred to me after watching the School of Life video because I thought about how if I studied my coworkers, immersing myself in that world by conducting an ethnography, I might notice how they……)”

Writing with another person or a group means using your professional writing talents. It also means working with a team and using your interpersonal skills. In the text, Kolin refers to guidelines for successful group writing and gives ideas on how to solve sources of conflict in group dynamics. When collaborating, it’s important to put your strengths to use and use the strengths of others to create the most effective communication product. What strengths do you bring to the collaborative writing table?

To prepare for this Discussion:
Read the following scenario:
You have been asked to collaborate with a group of people to create a written marketing brochure that will eventually be disseminated to individuals external to an organization.

Listen to the audio interview with Kim Skeen and Cari Stein. Consider how this duo successfully collaborates on writing and media projects.
Consider the fundamental writing skills that you will have to utilize when collaboratively working on this project. Why do these skills matter when writing in a professional setting?
Reflect on what strengths you bring to the collaborative writing format. How will you be able to use the strengths of others to help you complete this project?
Consider the people you encounter on a daily basis, such as your boss, your coworkers, or your clients. What is your role when you interact with these people? How does your role change when you interact with your family or friends?
Reflect on what strengths you bring to the collaborative writing format. How will you be able to use the strengths of others to help you complete this project?
Review the pages in this week’s Resources from Chapters 3, 13, and 15 in the text. Think about the guidelines in the text for collaborative writing and group dynamics. How can you use those guidelines for this example?
By Day 3
Post 2–3 paragraphs analyzing the approaches to writing collaboratively in a professional setting.

What kinds of elements do you need to consider when creating this brochure, and how does your approach differ when compared to working independently on a similar, written medium?

What personal and professional opportunities would working in a diverse collaborative group provide for you?
Cite at least two examples from your readings to support your answers

Write an essay in response to TWO questions. Your total essay should be around 5-6 pages (if you go college essay help near me

Write an essay in response to TWO questions. Your total essay should be around 5-6 pages (if
you go over, then that’s no problem) in answering two total questions. Your paper should be in
typical academic format (12 pt. font, Times New Roman, etc.). Most prompts require you to
restate someone’s argument and argue for your own position on some issue. MAKE SURE TO
ARGUE FOR YOUR POSITION!!! I neither expect nor require full-proof, knock-down
arguments here, but I do expect and require for you to give the best argument you can. IF YOU
DO NOT ARGUE, THEN YOUR GRADE WILL SUFFER—MERE ASSERTION OF
YOUR POSITION IS NOT AN ARGUMENT.
Let me offer you a bit of a warning. A lot of students want to argue for/against some moral
theory because it has good/bad implications for our lives. That is, some of you may argue for X
(moral theory) because X has really good or beneficial consequences for us. The problem with
this kind of argument is that it shows the wrong thing. I’m not asking below if any ethical theory
or issue is beneficial or has good practical results—I’m asking of the theory or issues is true or
correct. Be careful not to confuse reasons to think X is a good think for reasons to think X is a
true or correct thing.
1)Do you think that there are moral facts or truths independent of human
thought/culture/belief? That is, are there truths about ethics or morality independently of our
thought about it? Basically, do you think ethical relativism, objectivism, or nihilism is true?
What are the best arguments from the readings we have discussed for and against the view
that there are (objective) moral facts? Basically, I want you to examine the arguments on
both sides and determine which theory you think is correct and argue for your position.
Make sure that you are explicit, clear, and not vague on any key terms in your paper (like
objectivism, relativism, and the like) and that you give me reasons that justify whatever
position you take. (Be careful, remember that moral relativism is NOT the claim that moral
beliefs or views differ. That is obvious and we can take it for granted. So, part of this essay
requires that you get clear on what relativism does say about moral beliefs and their relation
to moral facts, truths, etc. If that’s unclear, it’s easy for the rest of the paper to slide away
from you. spend time and thought on this question: it’s important for the rest.)
2. Do we have moral obligations to others that are not grounded in our own self-interest? That
is, is morality fundamentally egoistic or non-egoistic? There can be egoistic motives to help
others; for instance, if you help someone else so that that person will give you something in
return. And there can be non-egoistic motives for your own self-interest; for instance, we
might have a duty to keep ourselves alive in order to help others. So, the question is NOT
whether you should help others, but instead it is about the basics of morality. Is morality
based on egoistic principles or non-egoistic ones? Be clear and precise about what exactly
egoism is (as a moral theory) and what it implies for our moral lives. Then, of course, argue
for your view on the issue. Evaluate the readings we have discussed for and against ethical
egoism. (Don’t confuse whether we DO act self-interestedly with whether we SHOULD act
self-interestedly. Even if we are egoists, that doesn’t mean that we should be. If you think we
are egoists, then you still need to argue that this leads to the moral claim that we SHOULD
be.)

For your paper, please write a 750-1000 word analysis of one or more of the literary works included in our Unit 1 reading list. Your analysis should interpret and “read” the literary text(s) through the lens of Feminist Criticism.

A literary analysis is a rhetorical construct or strategy that typically employs the following organizational pattern: first, an introduction presents the author(s) and text(s) to be examined, along with a certain amount of summary/synopsis of the work(s), and, of course, the paper’s thesis; next, a section of the paper is devoted to a brief discussion of the critical approach being used to direct the analysis, as well as relevant background material (biography, history, etc.); and then the paper provides a clear, close reading of the text(s), supported with specific examples and appropriate secondary sources.

As we progress through the unit, we will discuss in class more specific potential topics for the texts included in Unit 1. Remember, your essay should conform to MLA guidelines for format and documentation.

A community is a commonality among a group of people.

I am a part of many communities including being a part of the military, a marine biology major, a female in STEM, and the college student community; and the list goes on and on.

The two communities that I belong to that stand out the most are the military and the marine biology major.

Being a part of the military is a very particular lifestyle. You start by talking to a recruiter, finding out what job suits you, and going to basic training. From basic training you are disciplined and taught to act, speak, and behave in very particular ways. From here, you are sent to your first duty station – another very intimidating thing. Then, your life is filled with years and years of work in the discipline you were put in with possible deployments and TDY’s (temporary duty stations). All very difficult things to deal with. Years and years of this becomes a lifestyle. Standing outside saluting if in uniform while the national anthem plays at 5 PM and again at 9 PM and again at 7 AM the next morning. Again, it is a very particular lifestyle. So, when someone leaves the military, how do they adjust to a life outside the military? In other words, how do veterans struggle to adjust to civilian life after leaving the military?

https://www.theatlantic.com/ideas/archive/2020/10/extremists-dont-belong-military/616763/

Well, the first and biggest thing is knowing where to start. Where do you live? What job do you do? How do you set goals for yourself? This can be very difficult for someone who spent most of their life in a position of being told where to go and what to do. Some veterans can struggle with direction.

Marine Biology is a highly underfunded and very important aspect of today’s world. With climate change and pollution as two of the world’s largest issues, marine biology is directly correlated. So, how does climate change affect coral reefs, and why are coral reefs so important?

https://www.thebalancecareers.com/marine-biologist-125619

Climate change is essentially a change in climate patterns that causes increased levels of carbon dioxide in the atmosphere; produced by the use of fossil fuels. These changes in the atmosphere can prove fatal to ecosystems across the world (Anthony, 2020). All ecosystems are dependent upon the coral reef species and some places like Jamaica, are mourning the death of 95% of their coral reefs (Neufville, 1998). Without these coral reefs, ecosystems across the globe will suffer from the changes that will take place in aquatic ecosystems (Wepener, 2020). According to the National Oceanic and Atmospheric Administration, “Fishes and other organisms shelter, find food, reproduce, and rear their young in corals” and “…restoring corals can change the trajectory of an entire ecosystem” (2019). These are some of the few issues that coral reefs are facing making it apparent for these coral reefs to be protected.

Write a 2-3 page paper on a business-related court case that is relevant to tort law. Introduction When one essay help free

Write a 2-3 page paper on a business-related court case that is relevant to tort law.

Introduction

When one party damages another party, in a non-criminal context, the aggrieved party is entitled to restitution. This is one of the most important concepts of tort law. In other words, making a party legally responsible for damages is the main purpose of tort law. A judge or jury will attempt to determine exactly what needs to be done when an aggrieved party can demonstrate damages, and what those damages should be in order to return the aggrieved party to the state that they were in prior to the alleged action. Of course, no one can go back in time and change what happened; therefore, damages are always paid in the form of money.

One reason why torts are important in a business context is that virtually all commercial enterprises deal with the public by providing products, services, or other commercially relevant activity. Unfortunately, consumers often suffer harm due to unintentional (or, rarely, intentional) damages caused by faulty products or negligent services.

Criminal penalties cannot be attached to business entities. If a crime is committed, the government charges specific individuals within the corporation who may be responsible, not the business entity. Yet, society recognizes that businesses, out of negligence, ignorance, or malfeasance, may cause injury to another party. Tort law imposes standards by which such injured parties can seek recompense from the corporation in civil court. Whereas an entire corporate entity cannot be tried in a criminal court, it can be a defendant in a civil court. Keep in mind that there is a significant difference between tort law and criminal law. Criminal penalties could be applied to individuals if there is evidence of an illegal motive or criminal negligence. Torts, on the other hand, typically involve negligence, which is a breach of a duty of care.

Overview

Tort law is based on the notion that if one party harms another intentionally or by being careless or reckless (“negligent”), then the aggrieved party may be entitled to restitution and be made “whole.” In some cases, there is strict liability, as in cases of defective products. If a product is found to be inherently unsafe or defective, strict liability is imposed; “strict” means that neither intent nor negligence needs to be proven.

Sometimes, a tort may also be a crime, as in the case of assault. Such a case can be brought both civilly and criminally. Here, we are only concerned with civil court cases. The court (using a judge or jury as fact-finder) will attempt to determine what damages are appropriate where a tort has been committed.

A court will attempt to determine exactly what needs to be done when an aggrieved party can demonstrate damages, and what those damages should be, in order to return a party to its state prior to the alleged action. This remedy is almost always money because, in reality, no one can go back and undo the wrongful action.

Preparation

The first step in preparing your case law analysis is to locate a published court decision and select an organization you believe would be impacted by the decision.

Instructions

Once you have selected a decision and an organization impacted by the decision, assume you’re a senior manager in the organization you selected and that you were asked to prepare an analysis of the court decision and brief the executive team of the organization about the impact the case might have on the company. Your briefing should include a summary of the case, as well as an evaluation of how the court’s decision impacts the organization from a business, legal, and ethical perspective. Be sure to list your case citation in the References page at the end of your briefing.

Step 1: Exhibit information literacy skills as applied to business law.

Identify the court, the parties who are before the court, and the date of the decision.
Ensure that your briefing provides an accurate context in terms of who brought the lawsuit and the outcome of the case.
Report research from a recognized authority that adds insight into the meaning, history, or impact of the case with relevant legal research from credible databases or online sources.
Step 2: Summarize the facts and ruling of a legal case and its impact on businesses.

Provide a brief background and context associated with the case. Summarize the facts in no more than 1-2 paragraphs.
Identify the specific disagreement between the parties. Was there a dissenting opinion? If so, explain it.
Summarize the court’s ruling, including its rationale.
Analyze the impact of the case on businesses, including both negative and positive impacts.
Step 3: Explain how the court decision impacts legal and ethical compliance in a business environment.

Identify the ethical and legal implications for a business that were suggested by the court’s decision.
Discuss whether or not the conduct of a party in the case was ethical or unethical.
Propose and explain an ethical theory that describes why a party’s conduct was ethical or unethical.
Step 4: Explain how a legal case could impact a specific organization not a party to the case.

Explain the impact of the court’s decision on your selected organization. In light of the court’s ruling, how might the executive team of the organization make future decisions or policy?
Additional Requirements
Based on your executive audience, your executive briefing should be no more than three pages, in addition to a References page, and should be well organized and written in clear, succinct language. Follow APA rules for attributing content to sources that support your analysis and conclusions.

Your submission should meet the following requirements:

Written communication: Write in complete sentences free from errors that detract from the overall message.
Font and font size: Arial, 12 point.
Format and length: Double-spaced, 2-3 pages.
Citations: Include complete citations of your sources along with a References page. Review Evidence and APA for more information on how to cite your sources.
