They claim the private institutions used the arrangements to continue to “have access to the federal student loan program.” One of the reasons it took the CFPB a bit to check into this is because private loans from the schools are usually exempt from laws under Regulation Z that other lenders must abide by. They’re also exempt if they follow some of the regulations regarding time frames for extensions and interest rates.

Some of the issues the CFPB has with the private institutions include restricting students in debt from future enrollments or graduations, or withholding transcripts, or accelerations with the payments, and/or charging extra fees to the student borrowers. The CFPB’s investigation will also focus on the lenders along with the schools.

I hope this will help future students as well as students who may have been taken advantage of in the past. One of my sisters-in-law took classes from Devry (I know, I know, we tried to tell her) and now owes $225K for a BS in computer science. She will most likely never be able to pay that back. I think it’s a good idea to look into this. It goes beyond buyer beware and what a reasonable person would be able to understand and agree to.

***2ND POST TO RESPOND TO:***A story that has been in the news this week is the settlement between Remington Arms and some of the families of the Newton Connecticut school shooting. Gun manufacturers have traditionally not been liable for what people had done with their guns which I agree with. We don’t sue Ford when we get a speeding ticket or McDonald’s when we get fat. This case was different in that the attorneys for the families sued over Remington’s marketing practices violating Connecticut’s Unfair Trade Practices Act. Congress passed the Protection of Lawful Commerce in Arms Act which granted immunity to gun manufacturers for criminal uses of the guns they make. This case may set a new tactic for others trying to sue gun manufacturers but I don’t know how many of them can be successful. Remington will not pay the settlement but their insurers will because they have went bankrupt twice in recent years. Gun control advocates may use this to go after insurers and bankers who make gun manufacturing possible, like how they are trying this to get rid of fossil fuel companies. I don’t know how you could advertise a gun except for target practice or hunting animals. It would be unethical to advertise guns to troubled young people as a way of getting revenge on people and being a hero or however they say Remington marketed theirs. The government may step in and regulate it like they do tobacco. It will be interesting to see how lawsuits play out going forward if unfair business practices are used as the basis.
