The Turnip Plaza Hotel

Mark Piper was employed for several years as a tour guide at the Turnip Plaza Hotel in Port Austin, Michigan. Turnip Plaza is one of Colossal Corporation’s luxury hotel holdings, strategically located near Lake Huron’s famous Turnip Rock. Over the years, Mark developed a reputation as one of the most skillful tour guides in Michigan. He would guide tourists through extreme kayaking, hiking, and camping adventures in and around the Great Lakes. He was often requested by name by tourists visiting the hotel and was featured on extreme sports television. His high adventure kayaking tours brought in significant revenue for the hotel.

One month ago, Mark was approached by Stacey Nguyen, the manager of the Huron Overnight Inn—a rival company of Turnip Plaza. Stacey offered Mark a substantial salary increase to leave Turnip Plaza and come to work for her. Mark agreed to think about this offer and get back to Stacey in 48 hours. When he returned to Turnip Plaza, he asked several of his colleagues what they thought about the offer. One of them immediately went to Turnip Plaza’s manager, Edward Griffin, and told him the details of Stacey’s offer to Mark.

Upon hearing of the offer, Edward called Mark into his office and said: “If you stay with Turnip Plaza, I promise that next month you will receive a promotion with a 50 percent raise and a guaranteed contract for a two-year term.” This sounded good to Mark, and he turned down the offer from Stacey to stay with Turnip Plaza. However, last week, shortly before Mark was to receive his new contract, he was dismissed from Turnip Plaza because of corporate restructuring due to concerns about the increased liability risks of managing high adventure tours through Colossal’s hotels. Although Mark has not taken any formal action at this point, the vice president is concerned that Mark might try to hold Turnip Plaza to Edward’s promise.

Your task is to research the legal and ethical issues associated with this situation and write a report to the vice president answering the following questions:

What legal theories might Mark use to try to legally enforce Edward’s promise? Explain the elements of these theories and how they apply to the facts of this scenario.

If Mark were to file a lawsuit and win, what sort of damages or other remedies might he be entitled to? Include your reasoning and any evidence that led you to your conclusions.

Finally, regardless of the legal implications, the vice president would like your view on the ethical issues. Does Turnip Plaza have an ethical obligation to fulfill the promise made by Edward to Mark? Is it right to lay off Mark under these circumstances? What should Turnip Plaza do from an ethical perspective? Use ethical theory and principles to analyze these questions.

Step 2: Gather and Analyze Information
INBOX (1 NEW EMAIL)

From: Kenneth Dodger, Vice President, Colossal Corporation

To: You

Good morning,

Hope you’ve had time to review the case file on The Turnip Plaza Hotel. In order to formulate a sound response to my questions, you’ll need to review a number of specific foundational issues involving legal contracts.

First, find the necessary information about contract formation and execution. Then, look into possible contract remedies for when a breach of contract occurs. As you read over this information, be sure to record your thoughts pertaining to the case, while noting the places in the readings that prompted your thoughts.

After you have refreshed your understanding of contract law generally, you should supplement that understanding by doing legal research on specific laws related to contracts in Michigan. Again, make sure to take notes as you read. Good notes will help you write your report.

Thinking over this case, put some of your focus on Edward Griffin’s role in this situation with Mark Piper. More specifically, consider whether Edward had the authority to make the promise he made (or any promises) to Mark.

Review the legal responsibilities of agents and employees to help formulate your answer. You should also review ethical business decision making, as it pertains to keeping promises in business situations and the ethical questions I have asked you to consider.

I trust you to perform with the same tenacity as you did with the first cases.

Thanks,

Ken

Step 3: Focus on Your Rationale and Conclusions: Create Your Outline
You’ve finished your research and reflected on how the facts and the law come together in this situation. You’ve also analyzed the possible arguments and determined which seem most reasonable (all things considered). Now it is time to formulate them, making sure to address all the concerns that VP Dodger expressed to you when you met. Outline the report that you will draft for your VP and review your document to make certain it covers all relevant points and progresses in a logical order.

After you finish the outline, if you have time, give yourself one night of sleep before you begin the next step, in which you will write the report. Fresh eyes might help you see points that need revision.

Step 4: Communicate Your Findings and Conclusions to the VP: Create Your Report
Use your outline and research notes to prepare your report for the VP. Be sure to meet the following requirements he has requested:

Format your report by including APA-formatted in-text citations and an APA-formatted reference list (do not format the body of the report using APA style, just the reference list). See references and citations for details.

Include a specific recommendation of what action, if any, the VP should take based on your analysis and conclusions.

Support your conclusion with references to legal principles and laws.

The report should be no more than 10 pages (double spaced, 12-point font; the reference list does not count towards page limit).

Title your file using this protocol: yourlastname_TurnipPlazaReport_date.

Submit your Turnip Plaza report to the submission dropbox located in the final step of this project. You should try to have this report complete by the end of Week 4.

In the next step, you will begin work on navigating some of the international legal challenges Colossal is facing.

Step 5: Review Colossal’s International Legal Challenges
Successfully completing the Turnip Plaza report, you’re ready to review your next assignment: the International Legal Challenges case file.

You open the file and read over the specifics of this situation. You soon see that VP Dodger is concerned about some of the risks involved with a number of Colossal’s international projects.

In the next step, you will gather the information you need to identify important issues for the VP.

Step 6: Gather and Analyze the Information
While you have some general awareness that there are many ramifications of international transactions from a legal perspective, including dispute resolution provisions, you realize that you need to know a lot more about this subject before you can attempt to respond to the VP’s questions.

You begin by researching international law, international contracts, an introduction to alternative dispute resolution, and international dispute resolution.

Step 7: Engage in the International Legal Challenges Discussion
Discussion with Colleagues

Now that you’ve gathered and analyzed information on the International Legal Challenges case file, Vice President Dodger would like you to discuss your thoughts with the other members of his special investigations team. He sends you two requirements for this discussion:

First, each participant is to post an initial response to at least two of the five questions noted in the International Legal Challenges file. This should be completed during Week 5 and should meet the following requirements:

Include a specific recommendation of what action, if any, the VP should take based on your analysis and conclusions.

Support your conclusion with references to legal principles and laws.

These posts can be as long or as short as you need in order to effectively make your points.

Second, each participant must provide a substantive response to at least one posting from a colleague in the discussion, critiquing the initial post by appealing to legal and business considerations. This should be completed during Week 5.

Consult MBA Discussion Guidelines for instructions on participation in discussions.

Comments THESES TWO RESPONSES SEPARATELY!!!!
1- P/E Ratio is a measure of a companies current share price in relation to its earnings per share. The profitability ratio often uses past data to show where a company stands. A company that has a high P/E Ratio probably suggests that the stock is being overvalued, and it is going to expect a higher rate than it will actually receive. The P/E/ Ratio is calculated by dividing a firms market price per share by its earnings per share. With this being said, both of these ratios are not really correlated. P/E ratios overlook specific assets in accounting that can severely impact a companies valuation. Profitability ratios on the other hand, constantly look at a companies ability to earn profit from its assets and sales, that a P/E ratio often overlooks. Investors of companies use P/E ratios to see the value of a company in relation to its shares. This is important to know BEFORE investing. This can also have no relation to the companies profitability. This ratio can also be used to compare different firms and companies.

Here’s how we get Breonna Taylor justice. Opinion by Attica Scott October 11, 2020 Attica Scott, a Democrat, is a member of the Kentucky House of Representatives. (1) Millions now know her name. But from the moment Breonna Taylor was shot and killed in her home by Louisville police, those with the power to right this wrong have tried to erase who she was and what she has come to stand for. To them, her name is not a rallying cry for justice and equity. It is a threat tearing down the rotted foundation on which they stand. They are right to be afraid. We are doing our work of justice in Taylor’s name. (2)As Kentucky’s only female Black legislator, and as the mother of two children near Breonna’s age, I have more than a vested interest in this case. I feel it in my bones. I have taken part in marches and rallies, breathed in tear gas and been accused — ridiculously and falsely — by the Louisville Metro Police Department of trying to burn down a treasured library in my own district. (3) The charges against me were an effort to silence me. It is a page from the same playbook of erasure and silencing that has been used against Taylor. We saw this playbook in action in March when LMPD officers felt no need to render aid to Taylor as she lay dying in her own hallway as a victim of a home invasion by police that never should have happened. We saw it in the LMPD’s attempt to dehumanize Taylor when it told the public — without evidence — that she was a “suspect” in a narcotics case. (4) And we saw it as the investigation into the events that led to Taylor’s death took months, and as protests in her name were met with unnecessary curfews, rubber bullets and tear gas from the very people who have sworn to serve and protect us. We saw it as our own governor called in the National Guard, whose bullets took the life of David McAtee, another bright soul in our community. (5) The latest attempt to erase Taylor’s life and legacy came last month from Kentucky Attorney General Daniel Cameron, who couldn’t bring himself to fight for true justice for Taylor before a grand jury. On Wednesday, Cameron filed a motion to gag a juror seeking the right to speak publicly about distortions in the attorney general’s presentation of the grand jury’s findings. Another attempted silencing. (6) We answer this effort by the powerful with raised voices. For more than 130 days, we have stood vigil in the heart of our city, demanding that Taylor’s death not be in vain. We want her killers held accountable. We want change in policies, practices and procedures that would keep tragedies like hers from happening again. (7) So far, our demands on behalf of Taylor have not been met. No officer faces a single charge tied to her death, and only one has been fired from his job. The judge who signed the initial no-knock search warrant has questioned whether she was misled. The FBI quietly continues an investigation that we hope will have our country do what our commonwealth would not. (8)Real political change has been slow, too, but here there has been some progress. City leaders have banned the type of no-knock search warrant used at Taylor’s home. Their settlement with Taylor’s family includes promised police reforms at an agency notorious for setting its own rules. Breonna Taylor’s voice was stolen from her, but we will not allow her to be erased. To do my part, with the help of Taylor’s family and the American Civil Liberties Union of Kentucky, I have proposed “Breonna’s Law” to seek sensible criminal justice solutions that should have been law all along. “Breonna’s Law” would expand Louisville’s recent ban on no-knock search warrants statewide and make sure judges determine whether violent entry to serve a warrant is necessary. “Breonna’s Law” would require all law enforcement to wear — and activate — body cameras when carrying out search warrants, and it would impose severe penalties if officers don’t comply. It would also require officers to undergo alcohol and drug testing following any shooting or otherwise deadly incident while on duty. (9)“Breonna’s Law” will be considered when the next state legislative session begins in January. I am grateful to the good people who have already provided so much support — 11 legislative co-sponsors and 3,600 community co-sponsors. As activists and leaders on the front lines for justice for Taylor, our resolve to sustain this movement is unbound. We cannot bring her back, but we can make sure that her name lives on — and that her legacy leads us to justice. May it ring in our ears forever. Breonna Taylor.

Emphasis and movement: Is anything being visually emphasized in this artwork? What contributes to this?
Rhythm and repetition: Is there a pattern in this artwork? If so, does it repeat and create rhythm?
(2) Finally, answer the following question. This is where you can be creative and bring in your own subjective interpretation: How do YOU think the artist has used these principles of design to create meaning? What does this sculpture signify to you?

For this assignment you need to discuss major ethical considerations related to scientific research and the communication of that Essay essay help free

For this assignment you need to discuss major ethical considerations related to scientific research and the communication of that research. The following criteria must be met:

There is a 1250-word count minimum for this assignment, and you need to use at least 3 credible journal references (e.g. not Wikipedia) sources. You will be expected to at least reach this minimum for both word count and reference count.
You need to discuss, in detail, at least 3 ethical considerations related to research and its communication.
Since this week’s topic discusses the ethics of research studies involving human participants, there is a feeling that all three of your considerations can be related to this. This is not the case, since these considerations are related to research, but not really its communication.
While some of these ethical considerations related to human research studies, you need to also include an example or two related to the ethics of research communication. Some examples are plagiarism, data fabrication, or data falsification.
There is also a required section that must focus on the mechanisms that are put in place to monitor research ethics and to ensure that ethical practices are being used. Please discuss at least 2 such mechanisms in detail.
This is a writing intensive class, therefore strong writing skills (including strong spelling, grammar, word usage skills) and a strong knowledge of the APA Style.
Properly cite the source(s) of your information for your paper directly after you use that information in your timeline, and list those sources in a properly formatted reference section.
Consult the APA Style Guide (Resources -> Student Success Center -> The Writing Center) for detailed information related to citations and reference section formatting
Be sure to review the grading rubric prior to creating your paper to ensure that you know what is expected for each section and how each section is weighted in terms of points.
You are required to submit this assignment to LopesWrite, so you need to abide by the GCU policies related to the maximum allowable LW report score for a passing grade (20%). Respond to the following two discussions and label each discussion in the pape. Discussion 1: The responsibility of a Essay writing essay help

Respond to the following two discussions and label each discussion in the pape.

Discussion 1:
The responsibility of a Christian to conduct research with integrity is exemplified in 2 Corinthians 8:21 “Providing for honest things, not only in the sight of the Lord, but also in the sign of men” (King James, 1769/2017). This verse specifically dictates the command of honesty in everything a Christian takes part in. This honesty is a duty to God and a duty to other humans. Research is a foundation for people to make decisions, and honest research directs the path of those who use it as a reference. Dishonest research is lying, it is also a stumbling block in the life of the person who refers to the inaccurate research.

Academic misconduct can be costly too. Kaplan (2019) provides evidence regarding a case of academic dishonesty in research that cost Duke University $112.5 million dollars in fees owed to the federal government. A researcher used false data to obtain grant money from the United States government (Kaplan, 2019). The amount of time, money spent in relation to the lawsuit, the reputation of the university, the reputation of those related to the researcher, and countless other variables would be related to an incident of this type. Respect and reputation are key factors in judging the integrity of individuals and institutions, and this researcher damaged the view of integrity of multiple people and a large university.

Another victim of this fraud is the taxpayers of the United States. People pay taxes to the government and they expect the money which is taken from them to be used responsibly and with accountability. The money given to Duke University under the false pretense could have been used by another agency responsibly, adding another dimension to the crime committed by the researcher who acted dishonestly. The University must also now allocate monies to an office which directs training in research integrity (Kaplan, 2019).

When individuals as parts of institutions decide to take part in amoral actions which lack integrity they break down the fabric of trust in society. Academic institutions are supposed to be pillars of honesty and integrity providing light and guidance to those who seek truth. When institutions break down, society follows. Society without direction and without a moral compass cannot create the trust needed to provide a foundation for progress. Integrity is an essential element of this foundation. Duty and honor to God and others creates a world in which all people can contribute to the harmony and purpose of living as Christ lived.

Discussion2:
Honesty guides good people; dishonesty destroys treacherous people. (Proverbs 11:3, NLT). Integrity and honesty are one in the same. It the responsibility of a Christian to be honest, to have integrity when living life. Being honest and having integrity will lead you on the right path to what is good, where as being dishonest can eat away at your soul and eventually, you will be found out. The same goes with research. It is everyone’s duty to conduct research with integrity, to be able to have the reputation of being honest so that trust may be built. We please God through our integrity. God praises those with integrity because it is through this integrity that we can make wise decisions.

There have been many reports of research misconduct in the scientific world the past few years. One from Duke University involving research and misuse of grant monies. Another from the University of Kentucky, where scientists played with numbers so that they could receive grants for their research. In the July, 2019 article titled, “Fudged research results erode people’s trust in experts”, it discusses how the research misconduct causes more scrutiny of the scientific world and the world of research in general. The article states there are many different reasons why research would be retracted or withdrawn. Some of those reasons may be: plagiarism, unreliable research, duplicating results, errors in results or analysis, and falsification or fabrication of data. (Moodie, 2019). Although the article is based on Australian research, the bottom line remains the same: research misconduct erodes the trust of the community, which can then create a snowball effect for others that may come afterwards.

Having integrity in life is important, being honest is having integrity. You cannot have one without the other. Trust is gained from having integrity and honesty and this is something that Christians need to base their beliefs on, since God is praising those with integrity and this is how we please Him as Christians.
